Estimates are based upon prices recently paid in galleries or at auction for comparable artworks. Estimates are subject to revision. Buyers should not
rely on estimates as a representation or prediction of actual selling prices or fair market value.
Conditions of Sale
A) Bidder is the Principal. When making a bid, a bidder is accepting personal responsibility to pay the purchase price if he or she is the highest bidder.
All sales are final. Purchasers may not request refunds or exchanges from
the donor or the Menil Collection.
B) Authenticity. The bidder assumes any and all risk, liability, and/or
responsibility for the authenticity and/or authorship of any item offered
at this auction.
C) Bid Recordation. All bids, including absentee bids placed by surrogates, must be made in writing on auction bid sheets or absentee bid sheets.
D) Absentee bids. The Menil Collection will use reasonable efforts to carry out written bids delivered to us prior to the sale for the convenience of clients who are not present in person at the auction. Bids will be placed competitively in increments up to the absentee bidder’s highest limit. Bids must be placed in US Dollars. Please refer to the website menil.org for the absentee bids form. If the museum receives written bids on a particular lot for identical amounts, and at the auction these are the highest bids on the lot, it will be sold to the person whose written bid was received and accepted first. Execution of written bids is a free service undertaken subject to other commitments at the time of the sale and we do not accept liability for failing to execute a written bid or for errors and omissions in connection with it. Acceptance of absentee bidding will close November 30, 2012 at 12:00 noon.
Buyers are expected to make full payment for purchases on the evening of the auction. If the winning bidder fails to make timely payment, the lot will revert to the nearest underbidder. Delivery or shipment of art will be subject to additional packing and shipping fees.
